Introduction
These Terms & Conditions ("Terms") govern your access to and use of the website ginger.healthcare (the "Website") and all related services provided by Ginger Healthcare Private Limited (CIN: U93090DL2018PTC337505), a company incorporated in India under the Companies Act, 2013, with its registered office at 108, Himalaya Palace, 65 Vijay Block, Laxmi Nagar, East Delhi, Delhi โ 110092 ("Ginger Healthcare", "we", "us", or "our").
Please read these Terms carefully before using the Website or engaging with our services. By accessing the Website, communicating with our counselors through any channel, or using any part of our services, you confirm that you have read, understood, and agreed to be bound by these Terms, our Disclaimer, and our Privacy Policy โ each of which is incorporated into these Terms by reference.
If you do not agree with any part of these Terms, please do not use the Website or our services.
Eligibility
The Website and our services are intended exclusively for individuals who are 18 years of age or older and who have the legal capacity to enter into a binding agreement. By accessing the Website or engaging with us, you represent and warrant that:
- You are 18 years of age or older
- You have the legal capacity to contract under applicable law
- You are not barred from receiving services under the laws of India or of your country of residence
If the patient seeking treatment is a minor (under 18 years of age), only a parent or legal guardian aged 18 or older may contact us and engage with our services on the minor's behalf. The parent or legal guardian is our user, is bound by these Terms, and is responsible for decisions made about the minor's care.
The Website contains information, images, and descriptions of medical procedures โ including some relating to intimate, cosmetic, or adult health matters โ that are not suitable for minors. If you are under 18, please do not use the Website.
Nature of Our Services
Ginger Healthcare operates as a medical tourism facilitator. We help patients โ primarily international patients and patients travelling across Indian cities โ connect with hospitals, doctors, and other healthcare providers for the purpose of receiving medical treatment. Our services are limited to:
- Helping you understand treatment options, typical costs, and timelines
- Introducing you to hospitals and doctors suited to your needs
- Coordinating consultations, appointments, and treatment plans
- Assisting with visa invitation letters, airport pickup, accommodation suggestions, and local logistics
- Acting as a communication bridge between you and healthcare providers before, during, and after treatment
- Providing post-treatment follow-up support where appropriate
We are not a hospital, medical practice, clinic, pharmacy, or healthcare provider. We do not diagnose illnesses, prescribe treatments, perform procedures, dispense medicines, or provide medical care. All medical services are provided directly by independent hospitals, doctors, and healthcare professionals ("Healthcare Providers") who are solely responsible for the medical care they deliver. A more detailed description of this limitation is contained in our Disclaimer.
At present, our facilitation services are focused on treatment in India. We may, in the future, extend our services to include other countries; these Terms will be updated accordingly if we do.
Our Fees and How We Are Paid
Our services are free of cost to patients. We do not charge you any fee โ whether as a consultation fee, coordination fee, booking fee, or otherwise โ for any part of our facilitation services.
We are paid by our partner hospitals in the form of a referral or facilitation fee for the patients we successfully introduce. This commercial arrangement does not affect the independence of our recommendations: we work to match you with hospitals and doctors that suit your medical needs, and we disclose this commercial model openly so that you can make informed decisions.
Availing our services does not increase the cost of your treatment. The amount you pay the hospital for your treatment is the same as it would be if you had contacted the hospital directly, without going through us. The facilitation fee we receive is paid by the hospital from its own margins and is not added to your bill, loaded into your estimate, or recovered from you in any other form. You are encouraged to verify this by comparing our estimates with any direct enquiries you make with the hospital.
No Handling of Your Money
We do not collect, hold, or process any payments on your behalf. You pay Healthcare Providers, hospitals, airlines, hotels, visa agents, and other third-party service providers directly, through whatever payment channels those providers accept. Ginger Healthcare will never ask you to transfer money to our accounts, and you should be cautious of any communication that claims to do so.
If you receive any unusual payment request purporting to be from Ginger Healthcare, please verify it directly with us at contact@ginger.healthcare before acting on it.
Your Responsibilities
By using the Website and our services, you agree to:
- Provide accurate information: share truthful, complete, and current information about your identity, medical history, symptoms, treatment preferences, and travel details. Withholding or misrepresenting material information may affect the quality of the care you receive
- Communicate respectfully: treat our counselors, Healthcare Provider staff, and anyone you interact with through our services with courtesy and respect
- Honour your commitments: once you confirm a consultation, treatment plan, or appointment, make reasonable efforts to attend, communicate delays promptly, and comply with the Healthcare Provider's requirements
- Make independent decisions: take your own informed decisions about medical treatment, travel, and related matters, consulting qualified medical professionals of your own choosing where appropriate
- Verify critical information independently: confirm doctor credentials, hospital accreditations, final treatment costs, and other critical details directly with the Healthcare Provider before committing to travel or payment
- Comply with all applicable laws: of India (as the country of treatment) and of your country of residence, including immigration, customs, currency, and medical laws
- Not misuse the Website or our services: as described in the "Prohibited Uses" section below
Third-Party Costs and Arrangements
All medical services, hospital stays, diagnostic tests, medicines, airline tickets, hotels, accommodation, visa fees, transport, and other third-party services are provided and billed directly by the respective third party. Their terms of service, pricing, cancellation policies, and refund rules apply directly between you and them โ not between you and us.
Ginger Healthcare will share information, estimates, and recommendations to help you make decisions, but we do not control pricing, availability, or service quality of third parties. Any disputes regarding third-party services must be resolved directly with the party concerned.
Cost Estimates, Timelines, and Treatment Outcomes
Any costs, price ranges, treatment timelines, recovery expectations, success rates, or similar information provided on the Website or by our counselors is indicative only and is based on typical cases. Final costs, schedules, and outcomes depend on the Healthcare Provider's assessment of your individual condition and on factors beyond anyone's control.
We do not guarantee any specific treatment outcome, cost, or timeline.
No Responsibility for Medical Outcomes
Because Ginger Healthcare does not provide medical care โ and is not involved in the clinical delivery of your treatment, the performance of any procedure, the administration of medicines, or any other aspect of medical practice โ we cannot be, and are not, responsible for the medical outcomes of your treatment. This includes but is not limited to:
- Unexpected, severe, or extreme side effects of medication, anaesthesia, procedures, or therapies
- Complications, infections, or adverse events arising during or after treatment
- Allegations of misdiagnosis, inappropriate treatment, delayed treatment, or substandard care
- Failure of treatment to achieve the expected clinical outcome
- Worsening of your underlying medical condition
- Permanent disability, loss of function, or death
Responsibility for medical care, clinical judgement, and the outcome of treatment rests entirely with the Healthcare Provider delivering the care. Any claim relating to the medical aspects of your treatment must be addressed directly to the hospital, doctor, or Healthcare Provider concerned, and is subject to the laws and regulations governing medical practice in the country where the treatment took place.
Our Recommendations Are Not a Medical Endorsement
When our counselors suggest a hospital or a doctor for your consideration, we do so on the basis of their accreditations, their experience with similar cases, patient feedback known to us, and the suitability of their facilities for your stated needs. A recommendation from us is not an endorsement of the quality of medical care, a guarantee of outcome, or a substitute for your own judgement.
You are strongly encouraged to:
- Consider multiple options before committing to a hospital or doctor
- Independently review credentials, accreditations, and patient reviews from sources outside our Website
- Ask the Healthcare Provider questions directly about qualifications, experience, procedural risks, and alternatives
- Seek a second medical opinion for serious or complex procedures
- Involve your family or trusted advisors in major medical decisions
The final decision to receive any treatment, from any Healthcare Provider, is yours alone. Please refer to our Disclaimer for a full statement of these principles.
Independence of Your Medical Decision
We believe strongly that the decision to undergo any medical treatment must be made freely, independently, and in your own best interests. Our role is to provide information, options, and logistical support โ not to pressure, influence, or hurry you into a decision.
Our counselors are trained to present you with suitable options, answer your questions to the best of their ability, and support you through the process. They are expressly prohibited from pressuring you to choose a particular hospital or doctor, rushing you through your decision, dismissing your concerns, or discouraging you from seeking second opinions or considering alternatives.
If, at any point, you feel that a member of our staff is pressuring you towards a medical decision โ directly or subtly โ please inform us immediately by writing to contact@ginger.healthcare with details of the incident. We take such reports very seriously. We will investigate promptly, and if the complaint is substantiated, we will take strict disciplinary action in accordance with our internal policies.
Regardless of any communication with our staff, the responsibility for your medical decisions โ including the choice of hospital, doctor, treatment option, and timing โ is yours alone. You should always take your own independent decision after considering all available information, feedback from trusted sources, and, where appropriate, the advice of qualified medical professionals of your own choosing.
Cancellations, Changes, and Refunds
Because we do not collect payments from patients, we do not issue refunds or process cancellations of third-party services. If you wish to cancel or change a consultation, appointment, admission, travel booking, or any other arrangement, please liaise directly with the Healthcare Provider, airline, hotel, or other service provider that you have paid or are committed to pay.
We will assist with coordination to the extent reasonable โ for example, by informing hospital staff of a delay or rescheduling โ but any refund, credit, or adjustment is subject entirely to the policies of the third party concerned.
